About the Free Will Writing Service

Bone Cancer Research Trust offers people the opportunity to make a simple single or joint will free of charge to encourage them to consider supporting Bone Cancer Research Trust with a gift in their will.

We’ve partnered with qualified, will-writing experts to offer our Free Will Writing Service through the following channels:

Bone Cancer Research Trust acts as an intermediary between our supporters and will-writing partners in the Free Will Writing Service.

The will-writing services are provided by our will-writing partners and not Bone Cancer Research Trust.

If you use our Free Will Writing Service, you will enter into a direct contractual relationship with your chosen will-writing partner, rather than with Bone Cancer Research Trust.

Liability

Although due diligence has been carried out on our will-writing partners, Bone Cancer Research Trust cannot make any guarantee or warranty as to the level of service that is to be provided by the will-writing partners.

Bone Cancer Research Trust therefore recommends that, before using our Free Will Writing Service, you conduct your own independent research into the various will-writing partners and will- writing methods available to you. We suggest that you only choose one of Bone Cancer Research Trust’s will- writing partners if after conducting your own research, you are satisfied with the service they aim to provide and happy that it suits your circumstances.

Once you have chosen your will-writing partner, you will be provided with their own individual terms and conditions, which will include full details of fees and the service that will be provided to you. Please check their terms and conditions and address any questions to them before you conclude your agreement with them and work begins.

Bone Cancer Research Trust is not responsible for losses you suffer where the loss is:

Unexpected. It was not obvious that it would happen and nothing you said to us before using our Free Will Writing Service meant we should have expected it (so, in the law, the loss was unforeseeable).
Not caused by a breach on the part of Bone Cancer Research Trust. We are not responsible for the services provided by any of our will-writing partners. You should, before using our Free Will Writing Service, conduct your own independent research into our various will-writing partners, check their terms and conditions and address any questions to them before you conclude your agreement with them and work begins.
Caused by a delaying event outside our control. As long as we have taken reasonable steps to prevent or minimise the delay, Bone Cancer Research Trust is not responsible for delays outside our control.
Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions.
A business loss. It relates to your use of the services for the purposes of your trade, business, craft or profession.

If you have any complaints regarding the services provided by the will-writing partner, you will be able to raise these with them directly by following their complaints procedure.

Payment for Wills under the Service

All simple single or joint wills prepared by our partners are paid for by Bone Cancer Research Trust, without cost to you. These costs are paid for from Bone Cancer Research Trust’s fundraising budget.

The price of the will varies depending on the will-writing channel and partner.

If you require a more complex will, or any additional legal services, there may be additional charges for you to pay as Bone Cancer Research Trust will be unable to cover these. If this is the case, your chosen will-writing partner will contact you to discuss the charges. Bone Cancer Research Trust recommends that you speak to your chosen will-writing partner about your needs before you commit to using the Free Will Writing Service so that you have an understanding of any costs that will be payable by you. These additional costs will vary depending on your chosen will-writing partner.

Please note that you will also be responsible for any disbursements i.e., payments that our will-writing partners have to pay out on your behalf to third parties.

Review and withdrawal of the Free Will Writing Service

Bone Cancer Research Trust is committed to regularly reviewing the cost-effectiveness of our Free Will Service. We reserve the right to amend or withdraw the Free Will Writing Service at any time.

Eligibility

You must be aged 18 or over to use the service.

Geographical restrictions apply. Some of our Free Will Writing Service are only available in certain countries of the UK. You must meet these restrictions in order to use the service. Visit bcrt.org.uk/legacy for further information or contact your chosen will-writing partner before proceeding.

Please note that our will-writing partners may require additional information from you or anyone else paying for additional services for you, to satisfy their “know your client” regulatory obligations, including a passport or driving licence, and proof of your residential address, before agreeing to undertake the will-writing service for you.

Timescales for making your will

If you use one of our will-writing partners as part of our Free Will Writing Service, you must complete your will within the timeframe stated in their correspondence with you.

The timeframe required to conclude the will-writing service will differ on a case by case basis and will vary depending on the will-writing partner.

The Free Will Writing Service will be provided subject to availability and capacity of our will-writing partners. On certain occasions, Bone Cancer Research Trust may be unable to provide the Free Will Writing Service and may have to refuse or postpone an application to partake in the scheme. Bone Cancer Research Trust also cannot guarantee that all will-writing partners will be able to provide face-to-face services at all times, and these services may sometimes be limited to online or over the telephone only.

Leaving a gift in your will to the Bone Cancer Research Trust

When you use our Free Will Writing Service, there is no obligation to include a gift to the Bone Cancer Research Trust. However, many of our supporters choose to remember Bone Cancer Research Trust in their will.

We are incredibly grateful if you do choose to leave a gift in your will to Bone Cancer Research Trust. Whether you choose to leave a percentage of your estate or a fixed amount, your gift will help to fund our life-saving work.
